Derek Millard-Smith is a Regulatory Lawyer who has specialised in Consumer and Parking Law for over a decade, he is the approved solicitor to the British Parking Association Membership and manages the BPA Lawline at JMW Solicitors, a legal advice line for all BPA members.

Derek put together the team who successfully represented Parkingeye against Barry Beavis in the Supreme court in 2015; he provided advice to the sector around the implementation of GDPR in 2018; and together with his team, is currently playing a key role supporting the BPA and wider parking sector in the drafting, challenging and sense checking the proposed Parking Code of Practice and its accompanying framework and standards.

Parking (Code of Practice) Act 2019 - getting the best result for our members

The BPA welcomes the introduction of the Parking (Code of Practice) Act 2019 and most of the measures it seeks to introduce, including a single code, a single appeals service, and a standard setting body. Indeed, we have lobbied for these elements for over a decade. However it must be noted that the government’s proposal to drastically reduce the deterrent effect of parking charges on private land has far reaching implications for consumers, landowners, and the parking sector.

It is crucial that any new measures build on the great strides that have been made to raise standards over recent years and do not unintentionally undo this good work and tarnish the whole parking sector. This session will see key industry figures being interviewed on a variety of workstreams to ensure that the best possible conclusion for the private parking sector is achieved.
